The agreement for using Prismly
These Terms of Use ("Terms") govern your use of Prismly, a color-analysis app for iPhone. Please read them carefully.
By downloading, installing, or using Prismly, you agree to these Terms. If you do not agree, please do not use the app.
We grant you a personal, non-commercial, non-exclusive, non-transferable, revocable license to use Prismly on Apple devices that you own or control, in accordance with these Terms and Apple's usage rules. You may not copy, modify, reverse-engineer, resell, or redistribute the app except as permitted by law.
Prismly analyzes selfies that you choose or capture. Your photos are yours. They are stored on your device, analyzed on-device, and are never uploaded to us. You are solely responsible for the photos you use and for keeping your own backups. We recommend keeping your device and iCloud backups current so you do not lose content you want to keep.
Prismly offers a premium upgrade, Prismly Plus, which unlocks the app's full color-analysis features. It is offered as auto-renewable subscriptions plus a one-time purchase, all billed by Apple through the App Store:
Payment is charged to your Apple ID account at confirmation of purchase. The weekly and annual subscriptions auto-renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period, at the price of the selected plan.
If you buy a subscription while a free trial is running, any unused portion of the free trial is forfeited. You can manage or cancel your subscription anytime in your App Store account settings. The price is always shown before you purchase.
In addition to these Terms, your use and any purchases are also governed by Apple's Standard End User License Agreement (the Licensed Application EULA), available at:

Prismly is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose, accuracy, or uninterrupted operation. Prismly's color analysis is intended for style and entertainment guidance only; it is not professional advice, and results may vary depending on lighting, your photo, and your device. You should treat any color season or palette result as a helpful suggestion, not a definitive judgment.
To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data or content, arising out of or related to your use of Prismly. Nothing in these Terms limits any liability that cannot be limited under applicable law, including your statutory consumer rights.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of Prismly after changes take effect constitutes acceptance of the updated Terms.
